Terms of Use

Effective 2026-08-04

Draft for legal review — bracketed placeholders are pending counsel finalisation. Not legal advice.

Effective date: 2026-08-04 · Provider: [FRUTEBOX LEGAL ENTITY], [FORM, e.g. BV/NV], registered office [ADDRESS], company no. [KBO/BCE], VAT [VAT NO.] ("Frutebox", "we", "us"). Contact: [info@frutebox.com].

1. Agreement

These Terms of Use govern your access to and use of the Frutebox website, web app, desktop and mobile applications, browser extensions, and developer API (the "Services"). By creating an account or using the Services you agree to these Terms. If you use the Services for an organisation, you represent that you may bind it.

2. Eligibility & age

You must be at least 18 years old to use the Services during the current release. The Services are not directed to children under [16/as advised].

3. Your account

You are responsible for your credentials and for activity under your account. Use strong authentication (2FA available). Notify us of any unauthorised use.

4. What Frutebox is

Frutebox is an AI assistant and workspace that generates and processes text, documents, images, video, audio/music and code, and can perform actions at your direction. Some processing runs locally on your device; other processing runs on Frutebox infrastructure and on a network of computers (see §11 and the Privacy Policy).

5. Your content

"Your Content" means inputs you provide and outputs generated for you. As between you and Frutebox, you own Your Content. You grant Frutebox a limited licence to process Your Content solely to provide the Services. We do not use Your Content to train AI models. Outputs may be non-unique.

6. AI outputs — no reliance

AI outputs may be inaccurate, incomplete, or offensive despite our safeguards. You are responsible for reviewing and verifying outputs before relying on them. Outputs are not legal, financial, medical, or other professional advice.

7. Acceptable use

Your use must comply with the Acceptable Use Policy, incorporated by reference. We may screen network-bound content for unlawful use as described in the Privacy Policy and AUP.

8. Actions taken on your behalf (agentic features)

Where you authorise Frutebox to take actions (edit or delete files, run commands, use connectors, act on pages), you are responsible for the permissions you grant and the resulting actions. Certain actions (changes outside a project folder, deletions) always require explicit confirmation.

9. Third-party tools & connectors

The Services may offer third-party tools and connectors. Third-party developers are responsible for their own tools. Frutebox provides containment, review, and removal but does not warrant third-party tools.

10. Fees & billing

Paid features are billed as described at purchase and in the Refund policy. Pricing is metered on real compute, not per token. Taxes/VAT may apply. Payments are processed by Stripe; we do not store full card data.

11. Processing location & the network

You may choose the region in which your requests are processed and stored. Some workloads run on a distributed network of third-party computers ("nodes") that receive only encrypted, redacted work and have no access to your readable content; sensitive workloads are restricted to Frutebox's own or trusted infrastructure.

12. Intellectual property

The Services, excluding Your Content and third-party materials, are owned by Frutebox and its licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services under these Terms.

13. Beta

During the early-access period the Services are provided on a beta basis under the Beta Terms: they may change, break, or be discontinued, and are provided "as is".

14. Suspension & termination

We may suspend or terminate access for breach of these Terms or the AUP, legal requirement, or risk to the Services or others. You may stop using the Services at any time and delete your account.

15. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind. Mandatory consumer rights under Belgian/EU law are unaffected.

16. Limitation of liability

[DRAFT — counsel to set.] To the maximum extent permitted by law, Frutebox is not liable for indirect, incidental, special, or consequential damages, or loss of data/profits; aggregate liability is limited to [the greater of amounts paid in the preceding 12 months / €[amount]]. Nothing limits liability that cannot be limited by law.

17. Changes to the Terms

We may update these Terms; material changes will be notified and the effective date updated. Continued use after the effective date constitutes acceptance; where required by law we will seek fresh consent.

18. Governing law & disputes

These Terms are governed by the laws of [Belgium]. Disputes are subject to the courts of [Brussels], without prejudice to mandatory consumer-protection venues. EU consumers may use the EU ODR platform.
